Description:

Several events involving the relationship between copyright law and the law of industrial designs have occurrred in 2024: the decision of the Federal Court of Appeal in French v. Royal Canadian Legion (Dominion Command) https://decisions.fct-cf.gc.ca/fca-caf/decisions/en/item/521376/index.do, the Kwantum decision of the Court of Justice of the European Union (https://curia.europa.eu/juris/document/document.jsf;jsessionid=5DA5D4FC5F96F8A75990D8EB16DBFC40?text=&docid=291566&pageIndex=0&doclang=EN&mode=req&dir=&occ=first&part=1&cid=339364), and the "Design package" (Regulation https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=OJ%3AL_202402822 and Directive https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=OJ%3AL_202402823). One should not forget either the latest international treaty on the subject, the Riyadh Design Law Treaty https://www.wipo.int/edocs/mdocs/sct/en/dlt_dc/dlt_dc_26.pdf. Our panelists will take pleasure in discussing these developments in order to provide you with an overview of the situation.
