Description:

This talk will trace the evolution of the Canadian copyright basket over time, both in terms of how many rights it contains, and how those rights relate to each other. This historical approach will show tension between Parliament’s desire to add new rights to the copyright bundle, and courts’ tendency to interpret those rights narrowly, or even to read them out of the Copyright Act entirely. The talk will conclude with an examination of the Supreme Court’s decision in ESA (No 2), and what that decision means in practice for both copyright litigators and transactional lawyers.
